Terms and Conditions of Use

EveryMac.com; its parent company, Kyle Media LLC; and its principal author thereof, Brock Kyle; provide this Terms of Use Agreement to the user (hereinafter referred to as "you"), as a paid user of the EveryMac.com Captcha-Free Lookup service or EveryMac API. By purchasing or using a token, you agree to be bound by the terms and conditions of this Agreement, as well as follow all applicable laws and regulations regarding such use. If you do not agree to follow the terms of this Agreement, then you may not purchase or use the EveryMac.com Captcha-Free Lookup service or an EveryMac API token.

Upon electronic or written notice published through the website or otherwise, EveryMac.com may modify this Agreement at any time. Any use of the EveryMac.com Captcha-Free Lookup service or an EveryMac API token by you after any such notice shall be deemed to constitute acceptance by you of such additions, modifications, or new conditions. You continue to agree to use EveryMac.com, the EveryMac.com Captcha-Free Lookup service and EveryMac API in accordance with all applicable laws and regulations and with the terms and conditions mentioned in this document. By using the EveryMac.com Captcha-Free Lookup service or EveryMac API, you agree to be legally bound and to abide by the Terms of Use, just as if you had signed this Agreement.

Usage Requirements & Restrictions

To purchase or use the EveryMac.com Captcha-Free Lookup service or an EveryMac API token, you must agree to the following usage requirements and restrictions:

  1. By purchasing the EveryMac.com Captcha-Free Lookup service or an EveryMac API token, you agree that all information provided by your registration is true and accurate.
  2. EveryMac.com maintains exclusive ownership of all text provided via the EveryMac.com Captcha-Free Lookup service and EveryMac API. You may not copy, scrape, index, archive, create derivative works, embed, cache, or otherwise in any way exploit, any of the text, in whole or in part.

EveryMac.com, its parent company Kyle Media LLC, and its principal author, Brock Kyle; shall not be held responsible or liable, under any circumstances, for any damages resulting from downtime.
  5. Usage is metered based on the daily limit for each plan but billed monthly for convenience. If you do not perform the maximum number of queries in one 24 hour period, unused queries do not "rollover" to subsequent days or months. If you reach the daily query limit, there is no penalty, but you will have to wait for 24 hours to perform additional queries (or switch to a higher volume plan).
  6. You agree to take reasonable efforts to secure your unique token for the EveryMac.com Captcha-Free Lookup service and EveryMac API.
  7. You may access the EveryMac.com Captcha-Free Lookup service and EveryMac API using a script, but the script only may be used manually by a human end user in an appropriate manner. The EveryMac.com Captcha-Free Lookup service and EveryMac API may not be accessed in an automated, systematic, rote, or procedural fashion using a script or otherwise.
  8. You may not intentionally enter false or inaccurate information into the EveryMac.com Captcha-Free Lookup service or EveryMac API for the purpose of attempting to generate serial numbers or for any other purpose.
  9. You may not use VPNs, proxies, or cloud services to attempt to cloak or conceal your identity or purpose.
  10. The EveryMac API may be used on or in conjunction with a website, app, or other function, but it must include the phrase "Powered by EveryMac.com" where EveryMac.com is a live link to https://everymac.com on any web page, app screen, or other location that includes a search box completely or partially powered by the EveryMac API as well as on any results page, screen, or other location that displays results from the EveryMac API.
  11. Any website, app, or other function using the EveryMac API must be designed for your employees or customers to interact with your inventory or other services and not to compete with EveryMac.com.
  12. You may not use the EveryMac API on any website, app, or in any other manner that is abusive, hateful, harassing, defamatory, threatening, vulgar, obscene, fraudulent or unlawful. The EveryMac API cannot be used in conjunction with content that can be interpreted as slander, libel, harassment, hate speech, obscenity, or pornography.

In general, remember that EveryMac.com is kindly allowing you to use the EveryMac.com Captcha-Free Lookup service and EveryMac API, which represents more than two decades worth of hard work. Be respectful and have integrity.

Usage Termination & Revocation

If you fail to follow any of the usage requirements or restrictions above, EveryMac.com reserves the right to terminate your unique token for the EveryMac.com Captcha-Free Lookup service or EveryMac API and ban your access to EveryMac.com altogether. EveryMac.com also reserves the right to take legal action against you.

If you copy anything from the EveryMac.com Captcha-Free Lookup service or EveryMac API or otherwise access or use these services in an inappropriate manner, an EveryMac.com algorithm is designed to counter inappropriate behavior. It may perform countermeasures including, but not limited to, automatically terminating your unique token. EveryMac.com reserves the right to permanently ban you from using the entire site, as well.

If your unique token for the EveryMac.com Captcha-Free Lookup service or EveryMac API is accessed or used by an unauthorized party, EveryMac.com reserves the right to take countermeasures or terminate your token without warning, as well.

No Refunds

You may cancel your access to the EveryMac.com Captcha-Free Lookup service or EveryMac API at any time via the PayPal account that you used to sign up for the recurring payment. There is no penalty charge, but your token will stop working immediately upon cancellation and there are no refunds offered for any remaining time or any unused number of requests associated with your token.

In the event that your usage of the EveryMac.com Captcha-Free Lookup service or EveryMac API is determined by an EveryMac.com algorithm or manual review to be in violation of the Terms of Use or otherwise inappropriate, your access to the EveryMac.com Captcha-Free Lookup service or EveryMac API will be altered or terminated and no refunds will be provided.

Furthermore, in the event that your access to the EveryMac.com Captcha-Free Lookup service or EveryMac API is terminated because you violated the Terms of Use or otherwise used your token inappropriately, it is your responsibility to cancel recurring payments via the PayPal account that you used to establish recurring payments. For those terminated for abuse or for any other reason, no refunds will be provided for any payments made from your PayPal account regardless of the status of your token.

Legal Agreement

If any provision or clause in this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions or clauses shall continue in full force and effect. This Agreement shall be construed and controlled by the laws of the United States. Any dispute arising from the terms or breach of this Agreement will be governed by the laws of the United States. Through the use of this website, you agree to personal jurisdiction by the United States.

This Agreement, is the complete agreement between EveryMac.com, its parent company, its author, you, and any other parties with respect to the subjects contained herein and supersedes any previous proposals, agreements, or communications, electronic, written, or oral between EveryMac.com and you.
